Broken disk experience?

As I was taking out my Sega Sports Tennis out of its box, the game CD just
snapped into two. Apparently the little plastic thing in the middle of the
box holding the CD was a little too rigid. I contacted Sega to see if they
would offer to send me a replacement game with a nominal fee, but they flat
out refused claiming the game was already out of warranty.

Has anyone experienced this (snapped game disk) before?

I've had a few splits and I think they said that dvd discs originally
should not be kept in jewel case type as they were more brittle and
could damage.
