Ken,
Problem #1: This sounds like a well known bug (usually called "early
resignation" by the AI opponents). It was fixed about 5 years ago in The
Conquerors patch 1.0C available at the official Ensemble Studios site. Or
at least it used to be. I can't find it now (almost everything points to Age
of Empires III). But I've also seen the patch in the downloads section of
some other sites that review PC games.
Now if you don't have The Conquerors... the patch just for AOK may be this

Problem #2: I have no idea (I'm not sure what you mean by "game does not
work"). But the patch might help on it as well.
